These Terms of Service ("Terms") are a binding agreement between you and Bowen Digital LLC, a Florida limited liability company ("we," "us," "our"), governing your use of the Purpost mobile application and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Purpost lets you create a post once and publish it to Instagram, Facebook Pages and TikTok. We provide a tool. We do not host, distribute, moderate, or control what you publish — the platforms you publish to do that, under their own rules.
You must be at least 13 years old to use the Service, and old enough to form a binding contract where you live. If you use the Service on behalf of a business, you represent that you are authorised to bind that business to these Terms.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You may not sublicense, resell, or make the Service available to third parties.
You agree not to use the Service to:
We may suspend or terminate access immediately for any violation of this section.
Using Purpost to publish means you also agree to the terms of the platform you publish to. Those platforms may change their APIs, restrict or revoke access, rate-limit requests, reject media, or remove your content at any time and without notice to us. We do not control those decisions and are not responsible for them. Features of the Service may change or stop working as a result.
If you believe content published through Purpost infringes your copyright, note that we do not host published content — it lives on Instagram, Facebook or TikTok, and those platforms operate their own takedown processes, which are the fastest route. You may also contact us at support@purpost.app with details of the work, the allegedly infringing material, your contact information, and a statement made in good faith. We will respond to valid notices and may terminate the accounts of repeat infringers.
If you send us ideas, suggestions, or feedback, you grant us an unrestricted, royalty-free right to use them without obligation or compensation to you.
We work to keep the Service running but do not guarantee it will be uninterrupted, timely, secure, or error-free. Posts may fail for reasons outside our control, including platform outages, rate limits, expired credentials, or media a platform rejects. The Service may be offered in beta or early-access form and may contain defects. We may modify, suspend, or discontinue any part of the Service at any time.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT POSTS WILL PUBLISH SUCCESSFULLY, THAT DATA WILL NOT BE LOST, OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, BOWEN DIGITAL LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST POSTS, LOST CONTENT, LOST REACH, LOST FOLLOWERS, LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify, defend, and hold harmless Bowen Digital LLC and its members, officers, and agents from any claims, demands, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from or related to: (a) your content; (b) your use of the Service; (c) your violation of these Terms; (d) your violation of any platform's terms or policies; or (e) your violation of any law or the rights of any third party.
You may stop using the Service at any time by disconnecting your accounts and deleting the app. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms, if required by a platform we depend on, or if we discontinue the Service. Sections 4, 8, 10, 11, 12, 14 and 15 survive termination.
Informal resolution first. If you have a dispute, email support@purpost.app and we will try in good faith to resolve it within 30 days before either side starts formal proceedings.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. You and we agree that any dispute not resolved informally will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. Nothing here prevents either party from seeking injunctive relief, or from bringing an individual claim in small claims court.
We may update these Terms. If a change is material, we will update the date above and notify you in the app. Continued use after an update means you accept the revised Terms.
